Online Booking Terms and ConditionsThe following terms and conditions apply when you make a holiday booking with us. Please ensure you have read and understood all the conditions as you will be contractually bound by them once your holiday is approved.

Your holiday contract Booking via us: When you make a booking via us you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these booking conditions. You must be at least 18 years old to make a booking with us. Your contract with Theochatris Akinita Limited is made once one of the following steps have been completed: 1. A confirmation email has been issued to you. 2. When a booking is made within 10 weeks of departure on holiday, direct by telephone and paid by debit/credit card and we give you verbal confirmation followed in writing. 3. If the booking is made on our website and you opt to pay at the time of booking, the time of the first payment and receiving an electronic communication confirming your booking. 4. If the booking is via us and not a directly advertised property (in which case you should refer to the terms and conditions set out here). Your contract with us will be governed by Cyprus Law (Greek, South Cyprus) and is subject to the jurisdiction of the Cyprus Courts at all times. Booking via Directly Advertised Properties: When you book property advertised by private owners your contract and all communication will be direct with the property owner. The terms and conditions you should refer to are set out here. Paying for Your Holiday You must pay a non-refundable deposit of 20% of the complete booking price. This can be made online via WorldPay secure online payment system. The full balance of your holiday price must be paid 10 weeks before your arrival using the following methods. If your holiday arrival is under 10 weeks you must pay the full balance immediately

Payment method Card payment security is probably one of the most significant concerns for both you and us during an online transaction. Online transactions if implemented correctly are more secure than a card transaction in the shop or over a telephone or by fax. The reason for this is information transmitted online is highly encrypted and uses complicated algorithms when transmitting data. Furthermore Merchants that process card details online have to be PCI (Payment Card Industry security standard) compliant. We have selected WorldPay to manage the processing of all online payments through our website. WoldPay's e-commerce solutions are trusted and utilised by thousands businesses, big and small, in all parts of the world. Furthermore they are PCI compliant and this gives added surety to us and our clients that all online transactions are conducted to the highest industry standard. Furthermore for us to operate with this facility, WorldPay requires that we conduct our e-commerce business to their required standard and that we operate our business in line with Industry standard regulations. Payment currency All prices for rentals and services on our website are quoted in Euros. We currently only accept payment in Euros.

Taxes Unless otherwise stated all prices quoted on our website will include a Value Added Tax of 15%

Booking online Booking your holiday rental is a simple and straightforward process from our site. Holiday villas that can be booked online will be clearly marked with the "Book online" tab. The process will guide your through the steps required to book online. All your personal details will only be captured via secured page (128 Bit SSL). Furthermore please note that we do not hold your credit card details on our site and that these are processed via WorldPay e-commerce merchant. Furthermore, to cover us legally, we must inform you that you will be sent an automated confirmation of your booking by email. This is to inform you that your booking has been received by us and a payment taken. However as soon as your booking is approved and processed (we normally expect this to be in 24 - 48 hrs of receiving your booking) we will email you to confirm a contract has been formed and honoured. This term covers us both in the event that an error has been made in pricing/availability and or within our booking software. It is also important that in the unlikely event of our no longer being able to supply a particular booking for a reason beyond our control. If this situation arises as we will contact you immediately to inform you and to ascertain whether our alternative holiday property would be acceptable for you to proceed with the booking. If in the event that we cannot confirm the booking due to unavailability, or any of the reasons mentioned above, or you are not happy with our alternative choice of holiday property we will refund the full booking amount.

|
Your holiday price We reserve the right to alter the prices of any of the holidays shown in our website/brochure. You will be advised of the current price of the holiday that you wish to book before your booking is confirmed.
|
|
|
|
Breakage deposit Details of a live credit card will be taken prior to arrival to cover any charges that maybe incurred due to breakages, damages or excess electricity usage. The acceptance of a booking of single sex parties and parties under the age of 21 must be agreed at the time of booking with the landlord via My Property. The passport of the lead member will be held by us for the duration of your stay. Please note that willful and negligent behavior will not be tolerated. In this event, your party could be asked to vacate the property. Payment of Breakages, Damages or Excess Electricity Usage: After departure, the property will be inspected to ascertain that there are no breakages etc., Should there be a report of breakages , damages or the meter readings show excess electricity usage (See ‘Fair Usage' under sub section ‘Air conditioning'), funds will be taken from your card in payment. Replacement to the property and/or reimbursement to the landlord will then be actioned by us.

|
Equipment All equipment supplied within the property should be left in the same condition as you first received them. Missing items and breakages will be levied to you and payment will be taken from your credit card. If there are any breakages please inform us immediately so that we can make arrangements to replace the item(s) for the next guest. BBQ's supplied should be returned clean as was supplied to you. Failure to do so will incur a 40€ penalty which will be charged to your credit card. Towels and clothing supplied in the property are not to be used on the beach. They can only be used in the property premises. Failure to do so will incur a further cleaning charge of 10€ per item. You should bring your own beach towel for this purpose.

Confirmation Please check your confirmation email, final itinerary and all other documents you receive from us, immediately on receipt. You must contact us immediately if any information appears to be incorrect as it may not be possible to make changes at a later date. We are responsible for providing the holiday we have confirmed to you. If you cancel or alter your booking later on, you may have to pay an amendment charge. We reserve the right to refuse your booking. If we do this we will refund any money already paid to us minus any fees we may have incurred to us.

If you change your booking If, after our confirmation email has been issued, you wish to change your travel arrangements in any way, for example your chosen accommodation, we will do our utmost to make these changes but it may not always be possible. Any request for changes to be made must be in writing from the person who made the booking. If one of your party withdraws from the holiday, someone else can take their place providing they satisfy the conditions of the original booking, and you inform us in writing at least 14 days before departure, we will help you to make any other changes. The Party Leader must sign the letter, and we charge a €25.00 administration fee, as well as any charges imposed on us by other service providers. If you make a number of changes to the same booking, we will only make a reasonable overall charge. Except for a change of name, any changes you make within 10 weeks of your departure will be treated as a cancellation and the cancellation charges shown in the section "If you cancel your holiday" may apply even to individual components.

If you cancel your holiday Since our business operates in Cyprus and is part of the European Union, by EU Law, you have the right to cancel your booking within 7 days of receiving a confirmed booking. In this event we will refund all charges to you as soon as we have received a written confirmation from yourself by email. Please email your cancellation to cancellations@mypropertycyprus.com and always ensure you quote your booking reference number when writing to us. Refunds will be issued from WorldPay within 30 days of a written cancellation being received and processed. Cancellation takes effect on the date we receive your email. If you cancel after we confirm your booking (i.e. after 7 days), you must compensate us for losses, as we incur costs from the moment you make the booking. The closer your cancellation is to the departure date, the less likely we are to recover the costs by re-selling the holiday or components at the brochure price. Our cancellation charges therefore increase as the departure date approaches, as shown below. If you have to cancel for a reason covered by your insurance policy, you should be able to recover the cancellation charges. Claims must be made directly to the insurance company concerned. When only some members cancel in a group that has booked a holiday together, the charge will be based on the price of their holiday only. Remaining passengers in the group must pay any increased costs for the holiday, including the full accommodation cost. Due to the nature of the product we supply there are certain offers that cannot be refunded due to them being very close to the rental period (rentals within 14 days of a confirmed). These strict conditions will be displayed to you at the point of booking.

Cancellation charges More than 12 weeks prior to departure - deposit and insurance premium (if applicable). 84 - 43 days prior to departure 40% of the cost of your holiday or loss of deposit whichever is greater. 42 - 29 days prior to departure 50% of the cost of your holiday or loss of deposit whichever is greater. 28 - 22 days prior to departure 70% of the cost of your holiday. 21 - 15 days prior to departure 90% of the cost of your holiday. 14 - 0 days prior to departure 100% of the cost of your holiday . |

If we change or cancel your holiday It is unlikely that we will have to make any changes to your travel arrangements, as we do start planning arrangements many months in advance. Occasionally, we may have to make changes and correct errors in the brochure or on the website and other details both before and after bookings have been confirmed. In the event of minor alterations, we will do our best to notify you before you travel. If a significant change or cancellation has to be made to your holiday arrangements we will notify you as soon as possible. You may then: a) accept the changed arrangements; b) take an alternative holiday subject to availability. If the alternative is of a lower price than that originally booked the difference (if already paid by you) will be refunded. If the alternative is more expensive you will have to pay the difference; or c) cancel your booking completely, in which case we will refund you all monies paid by you except for administration fees for changes you have made and credit card charges. IMPORTANT NOTE: Compensation arrangements do not apply to circumstances beyond our control. We can cancel your holiday arrangement in the following circumstances: war, threat of war, riots, civil strikes or terrorist activity, industrial disputes, natural or nuclear disasters, fire, airport, port or station closures, bad weather conditions and similar events beyond our control. |

Your holiday travel Delays We are unable to accept any liability for any delay to your flight, ferry crossing or train journey whether the delay or cancellation is caused by adverse weather conditions, the action of air traffic controllers, the action of port, airport authorities or governments, the rescheduling of times by the carrier, mechanical breakdown, strike or industrial action or otherwise. In such circumstances you may be able to make a claim under your insurance policy.

Your Accommodation This is reserved exclusively for the people named on the confirmation invoice and no other persons are permitted to stay at the accommodation unless this has been agreed with us in writing and appropriate payments made (if applicable) additional guests will be asked to vacate by resort staff, accommodation supplier or other person in authority. Should you or any member of your party be responsible for any breakages, loss or damage of any item of the property or additional cleaning has been necessary, a charge will be made locally or an invoice will be sent to you on your return. The charge will be covered by your breakage fee in the event of accidental damage only. Please note that single sex parties and/or group of young adults (all have to be 21 or above) is not acceptable. We can under exceptional circumstances request approval from the landlord. If this applies to you please enquire with us before booking your holiday. Furthermore we have the right to refuse your booking if we feel that your group does not meet our strict standard of acceptance as we have an obligation to look after and maintain all properties listed on our website.

Accommodation Description The descriptions and information contained on the website are personally written by Theochatris Akinita Limited, and are made in good faith. It is possible that changes in facilities or a mistake in description may occur without our knowledge. In this event we will endeavour to inform you of any changes, once known, but cannot be held responsible for any inaccuracies in our Advertising. Details of the sleeping accommodation are contained in our descriptions. Water and electricity supplies are often not as reliable as in Great Britain, interruptions of supply do occur. We cannot be held responsible for these supplies or any other lack of facilities beyond our reasonable control. Only persons named on the booking form shall be allowed to occupy the accommodation and in no circumstances can the maximum number of persons stated on the website be exceeded. The Company has taken all reasonable care in making the booking arrangements for accommodation offered on the website. All properties are privately owned and Theochatris Akinita Limited is acting as agents for the owners or their representative. Theochatris Akinita Limited does not own or operate the airlines or car hire companies. It does not, therefore, accept any liability for death, personal injury, loss, damage or inconvenience from the provision of these holidays, where due to neglect, act or omission of any other company, firm or individual or the employees or the agents thereof. Theochatris Akinita Limited reserves the right to visit the property at any reasonable time to undertake any essential repairs, maintenance, pool cleaning, gardening and house keeping.

Special requests If you have a special request that does not form part of the arrangements described on the website or in our brochure please inform us in writing. We will do our best to comply but cannot guarantee to do so and it will not form part of our contracted obligations. We regret that we are unable to advise prior to departure if special requests cannot be met. We will make every effort to accommodate your request and inform the relevant airline or supplier concerned. However we cannot guarantee that special requests will be provided and recommend that you repeat your request to the relevant supplier at the appropriate time.

Our liability to you Our liability in all cases shall be limited to Cyprus Law and we will not accept responsibility for any of the following circumstances a) if you or any member of your party is at fault, b) if the fault is of someone else not connected with providing the services which make up the holiday which we have confirmed to you, c) any unusual or unexpected circumstances beyond our control which we could not have avoided even if we had used all possible care, d) any event which we or the supplier could not help or prevent.

Local activities Theochatris Akinita Limited does not act as an agent for any supplier/owner of any activities/excursions advertised or booked in resort. Therefore if you utilize any services locally your contract will be with the local supplier/owner and not Theochatris Akinita Limited and we will not be liable for any complaints, claims loss or damages in relation to these activities/excursions. |

If you have a complaint If you have cause for complaint whilst on holiday or travelling to your destination, this must be brought to the attention of a Theochatris Akinita Limited representative or relevant supplier immediately so that action can be taken at the time to rectify the problem. Should the representative/ local agent/ supplier or villa management company be unable to resolve the matter, details of the complaint must be notified to Theochatris Akinita Limited in writing within 28 days of the end of your holiday. Any claims received outside this period or these not reported on holiday cannot be considered as if you do not tell us about your complaint promptly, it may prove difficult to investigate or rectify your complaint.

|
Behaviour At all times during your holiday, you are expected to have consideration for other third parties. If in the opinion of ourselves, any accommodation owner or other person in authority, you are or appear to be behaving in such a way as to cause, or to be likely to cause, danger, distress, annoyance or damage to property, either ourselves or the supplier concerned may terminate your booking arrangements. In this situation, we will have no further liability to you and will not be responsible for meeting any expenses you incur as a result, making any refund or paying any compensation. In addition, you will be responsible for any expenses we incur as a result of your behaviour, such as the cost of damages to a villa. |

|
Passports, visas and health requirements It is your responsibility to ensure you have a valid passport and visa (if applicable). Theochatris Akinita Limited is not responsible for your failure to hold a valid passport or visa which may hinder you to travel and hence loss of your booking.
|
|
|
|
Airconditioning The use of any Air-Conditioning Units and electricity in the villa is included at no extra cost. The units must only be used while you are in the Villa, with all the windows and doors kept closed. Please ensure your switch off all the lights before you leave the property. Under no circumstances must the units be left on continuously while the Villa is unoccupied. Should the unit fails to operate, Theochatris Akinita Limited cannot be held responsible for any loss of use during your vacation but will try to repair or replace the unit a.s.a.p. An acceptable usage policy applies to electricity consumption within your property and we will take meter reads before and after you vacate the property. If the usage is more than we term as "fair", we will charge the extra amount per day per utility times the number of days you occupied the property from your credit card. As a guide daily usage of electricity should not exceed 35 KWh per day (for a 3 bedroom property) of stay and any extra usage beyond this amount will be charged at 0.15€ per KWh. This will be taken from your credit card.

Smoking Smoking is not permissible (unless stated) in all our properties advertised (long and short term lets) and failure to do so will be deemed as breach of contract and will give notice to vacate the property immediately. Smoking is also not permissible in communal areas such as corridors, lifts and lobby area, however you are more than welcome to smoke outside, around the pool area not causing a nuisance to other guests nearby. Smoking within properties leaves bad odours and we will charge you another 200€ to get the property professionally valeted.

Pets Pets are not allowed in any of our properties advertised (unless specifically stated) and breach of this regulation will mean breach of contract and removal from property. |

Building Works Building works and the resulting noise from the site can take place at any time during the year on an adjoining or nearby property and land. If this work is affecting your holiday please report this to us immediately. Obviously this is beyond the control of ourselves, but we will make an effort to have the work stopped if possible. Unfortunately we do not receive advance notice of when building works will begin as they are carried out by third parties over whom we have no control. Whilst we can assure you we will do our best to minimize any inconvenience or interruption to your holiday, we regret that this is beyond our control and we can not accept any liability or pay any compensation.

Arriving and Vacating All properties must be vacated by eleven hundred hours (11 am). Failure to do so will incur 100€ penalty per day which will be taken from your credit card. If your flight is later on in the day and you wish to extend your stay, and if we do not already have a back to back booking we may be able to arrange a late check out service. Note there will be a late check out charge which will be payable in cash in local currency 3 days before your departure date or from your credit card. Please also note that if we do offer a late check out service and we do take another booking on the day of your departure we have the right to refuse the late check out. In this case we will refund the money you have paid to us for this service. For a guaranteed late check out we recommend you opt for an extra night's stay, in which case you have your holiday property exclusively for yourself. You may take possession of your property after fifteen hundred hours (3 pm). Under certain circumstances we may allow you to leave your luggage within the property whilst it is being cleaned and prepared for you, but we will not take any responsibility of loss or damage of any your items. Water Usage You should be aware that due to water shortages in Cyprus, the mains water will be switched off occasionally by the Municipality for intermittent periods and therefore water consumption should be used in moderation.

Data protection policy In order to process your booking and to ensure that your travel arrangements run smoothly and meet your requirements we need to use the information you provide such as name, address, any special needs/dietary requirements etc. We take full responsibility for ensuring that proper security measures are in place to protect your information. All personal data captured on our website is via SSL 128 Bit encryption. We must pass the information on to the relevant suppliers of your arrangements such as villa management companies/villa owners, transport companies etc. Furthermore when you book your holiday online and make payment (over the internet using our site) we confirm that we will not hold any of your credit card details on our site. We use WorldPay for this service and if you suspect fraud has been committed with your payment card you should contact WorldPay immediately to resolve the issue. Furthermore information may also be provided to security or credit checking companies, public authorities such as customs/immigration if required by them, or as required by law. Additionally, where your holiday is outside the European Economic Area (EEA), controls on data protection in your destination may not be as strong as the legal requirements in this country. We will not, however, pass any information onto any person not responsible for part of your travel arrangements. This applies to any sensitive information that you give to us such as details of disabilities, or dietary/ religious requirements. (If we cannot pass this information to the relevant suppliers, whether in the EEA or not, we cannot provide your booking. Promotional offers From time to time Theochatris Akinita Limited may promote special offers. Offers cannot be used in conjunction with another offer running at the same time. Furthermore due to the nature of some offers, we may not be able to provide a full refund. This will be made clear to you during the booking process and you will have to agree to these terms before we will accept a booking from yourself.
